Terms of Service

These Terms govern CreativeFly creative-production services, subscriptions, credits, and AdSignal.

1. Agreement and operator

These Terms of Service govern your access to and use of CreativeFly websites, applications, AI creative-production features, reference analysis, templates, asset and project workspaces, subscriptions, credits, and CreativeFly AdSignal (together, the “Services”). The Services are operated by Spacetime Creative Pte. Ltd (“CreativeFly,” “we,” “us,” or “our”).

By accessing or using the Services, creating an account, submitting content, purchasing a paid feature, or otherwise indicating acceptance, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility and accounts

You must be legally able to enter into a binding agreement and, when acting for an organization, have authority to bind that organization. The Services are intended primarily for business and professional creative work and are not directed to children.

You must provide accurate information, keep credentials and verification codes confidential, and promptly notify us of suspected unauthorized use. You are responsible for activity under your account except to the extent caused by our breach of these Terms or applicable law.

3. The Services

CreativeFly provides AI-assisted image and video generation and editing, reference analysis, templates, asset and project management, collaboration, delivery, subscriptions, credits, and related features. Generation tasks are asynchronous and completed results are saved to Assets where the applicable workflow supports them.

Specific functionality, providers, models, quotas, plans, prices, and availability are shown in the applicable interface or order. We may add, modify, suspend, or discontinue features for operational, technical, legal, provider, or security reasons, subject to any notice or remedy required by applicable law or an executed agreement.

4. Your content, inputs, and outputs

You retain your rights in content you submit. You represent that you own or have all permissions needed for submitted images, video, audio, text, trademarks, likenesses, templates, datasets, and instructions, and that our processing of them as requested will not violate law or another person’s rights.

You grant us a limited, non-exclusive licence to host, copy, transmit, analyze, transform, generate from, display, back up, and otherwise process your content only as reasonably needed to provide, secure, support, and improve the Services, comply with law, and resolve disputes. This licence does not transfer ownership of your original content.

AI outputs may be inaccurate, incomplete, non-unique, or subject to third-party rights and provider restrictions. You must review outputs for accuracy, legality, rights clearance, disclosures, and fitness before publishing, advertising, distributing, or relying on them.

5. Acceptable use

You may not use the Services for unlawful, fraudulent, deceptive, harmful, infringing, privacy-invasive, discriminatory, sexually exploitative, or otherwise prohibited activity or content. You must comply with advertising, intellectual-property, privacy, publicity, consumer-protection, sanctions, export-control, and other laws applicable to your use.

You may not disrupt the Services; introduce malware; evade access, safety, billing, geographic, or usage controls; probe or reverse engineer except where law expressly permits; perform unauthorized scraping or bulk extraction; impersonate others; or misrepresent the source, authenticity, or verified performance of content.

We may investigate suspected misuse and remove content, limit functionality, suspend or terminate access, preserve relevant evidence, or report conduct where reasonably necessary to protect users, providers, the Services, or comply with law.

6. Third-party services and AdSignal

The Services may depend on cloud, payment, communications, analytics, AI model, data-provider, platform, or content-delivery services operated by third parties. Their own terms, licences, availability, and restrictions may apply. We do not control third-party services and cannot guarantee continued availability or unchanged interfaces.

AdSignal may process official public transparency records, advertiser-authorized data, licensed data, permitted public observations, and modeled estimates. Such information is not a guarantee of spend, sales, conversions, return on ad spend, legality, endorsement, or future performance. You must not use it to reconstruct private profiles, bypass platform controls, or republish prohibited raw datasets.

7. Subscriptions, credits, and payment

Some features require a subscription, credits, usage fees, or a separate order. Price, currency, included usage, renewal term, taxes, payment timing, and cancellation terms are shown before purchase. Payment providers process payment credentials.

Subscriptions automatically renew for the selected billing period until cancelled through the available account or billing controls. Cancellation takes effect at the end of the current paid period unless the purchase interface or applicable law states otherwise.

Credits are a limited, non-transferable right to use eligible Services, have no cash value, and cannot be redeemed for cash except where required by law. The amount of service available for a credit may change as models and provider costs change. Except where applicable law, the purchase interface, or an executed agreement requires otherwise, delivered, activated, renewed, or consumed services are non-refundable.

8. CreativeFly intellectual property

CreativeFly and its licensors retain rights in the Services, software, interfaces, designs, documentation, trademarks, templates, and materials we provide, excluding your content. These Terms grant you a limited, revocable, non-exclusive, non-transferable right to use the Services during the applicable service period.

Your rights in generated outputs depend on applicable law, your inputs, third-party materials, model or template terms, and any separate agreement. No provision grants rights that CreativeFly does not possess.

9. Availability, suspension, and termination

The Services may be interrupted or delayed by maintenance, upgrades, provider failures, security events, network conditions, regulatory requirements, force majeure, or other circumstances. We will use reasonable efforts to restore material functionality but do not promise uninterrupted or error-free operation.

You may stop using the Services at any time. We may suspend or terminate access for material breach, non-payment, credible security or legal risk, discontinued dependencies, or where required by law. Provisions that should survive termination by their nature will survive.

10. Disclaimers and limitation of liability

To the extent permitted by law, the Services and outputs are provided on an “as is” and “as available” basis. We do not warrant that AI outputs, recommendations, source coverage, or modeled estimates will be complete, accurate, unique, current, legally cleared, or suitable for a particular purpose.

Nothing excludes liability that cannot lawfully be excluded. Subject to that rule, CreativeFly is not liable for indirect, incidental, special, exemplary, punitive, or consequential losses, or loss of profits, revenue, goodwill, data, or business opportunity arising from your content, use of outputs, third-party services, or circumstances beyond our reasonable control. A signed enterprise agreement controls over inconsistent public terms for that customer.

11. Privacy

Our Privacy Policy explains how we process personal information, creative-production content, and AdSignal source data, including international processing, security, retention, deletion, and rights requests. If these Terms and the Privacy Policy conflict on personal-information processing, the Privacy Policy controls.

12. Governing law and disputes

Unless mandatory law or a signed agreement provides otherwise, these Terms are governed by the laws of Singapore. The parties will first attempt to resolve a dispute in good faith. Unresolved disputes are subject to the exclusive jurisdiction of the courts of Singapore.

Mandatory consumer and data-protection rights in your jurisdiction remain available where they cannot lawfully be waived.

13. Updates and contact

We may update these Terms to reflect changes in the Services, providers, law, or risk controls. We will publish the updated version and provide additional notice when required.
